This seminar will explain the current legal framework surrounding settlement negotiations. You will gain practical strategies for navigating settlement agreements fairly, while staying fully compliant with employment law.
Key areas covered:
- When and how to initiate settlement discussions including "without prejudice" and protected conversations under section 111A Employment Rights Act 1996.
- Negotiating successful exits covering compensation, notice, tax treatment, references, confidentiality and other key commercial terms often included in settlement agreements.
- Avoiding common legal pitfalls including allegations of undue pressure, discrimination, whistleblowing and improper behaviour that can undermine settlement discussions.
