ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND RELEASE OF CLAIMS
BINDING LEGAL AGREEMENT: PLEASE READ CAREFULLY BEFORE PURCHASING A TICKET OR ATTENDING THE EVENT.
By obtaining, checking out, or otherwise purchasing a ticket, registering for, entering, or attending this event (the “Event”), I acknowledge and agree to the following terms:
1. ASSUMPTION OF RISK. I understand that attending the Event may involve risks, including but not limited to personal injury, illness, exposure to communicable diseases, accidents, property loss or damage, and other foreseeable or unforeseeable risks associated with attending an event, traveling to or from the venue, participating in activities, or interacting with other attendees. I voluntarily assume all risks associated with my attendance and participation, to the fullest extent permitted by law.
2. WAIVER AND RELEASE OF LIABILITY. To the fullest extent permitted by applicable law, I hereby waive, release, and discharge Ampere Law Firm, its owners, attorneys, employees, agents, event organizers, sponsors, volunteers, representatives, and affiliated persons or other entities which are hosting this event inclusive of the venue, the Big 5 Club (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or relating to my purchase of a ticket, attendance at, or participation in the Event, including claims for personal injury, illness, death, or property loss or damage, to the extent such claims may lawfully be waived or released.
3. AGREEMENT NOT TO SUE. To the fullest extent permitted by law, I agree not to initiate, maintain, or pursue any lawsuit or other legal proceeding against any Released Party concerning any claim that I have expressly waived or released under this Agreement. I understand that this provision does not apply to claims that cannot lawfully be waived or released.
4. VOLUNTARY PARTICIPATION. I acknowledge that my attendance is voluntary, that I have had the opportunity to read this Agreement before attending, and that I may choose not to attend if I do not agree to its terms.
5. BINDING EFFECT AND ACKNOWLEDGMENT. I expressly acknowledge that this Agreement is intended to be a legally binding contract. By purchasing my ticket, checking the applicable acknowledgment box, or otherwise affirmatively accepting these terms as a condition of registration, I confirm that I have read and understood this Agreement, understand that I am waiving certain legal rights, including the right to bring certain claims or lawsuits, and voluntarily agree to be legally bound by its terms. I understand that this Agreement is not merely an informational notice or statement of event policy.
6. SCOPE AND SEVERABILITY. This Agreement applies to me and, to the extent permitted by law, my heirs, personal representatives, and successors. If any provision is found unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law.
7. GOVERNING LAW. This Agreement shall be governed by the laws of the State of Florida, to the extent applicable.
BY ACCEPTING THESE TERMS, I CONFIRM THAT I HAVE READ THIS AGREEMENT, UNDERSTAND ITS LEGAL EFFECT, AND AGREE THAT IT IS BINDING UPON ME TO THE FULLEST EXTENT PERMITTED BY LAW.
