Managing Self-Represented Parties in a Tribunal - Tips, Tricks and Pitfalls
Understanding of the unique difficulties posed by self-represented parties is important for all decision-makers.
Access to justice remains a cornerstone of the Australian legal system, however it is not uncommon for individuals to appear in a Tribunal or Court without legal representation and the numbers are growing.
Self-represented parties pose significant challenges for decision-makers as they are unfamiliar with legal procedure, evidentiary rules and substantive law.
Decision-makers need to ensure that obligations and expectations are communicated to parties appearing in person from the beginning to ensure cases are managed efficiently and respectful conduct is maintained.
COAT is hosting a panel discussion to explore these issues and provide practical guidance for decision-makers . The panel will include members from the Mental Health Tribunal (MHT), Victorian Civil and Administrative Tribunal (VCAT), Planning Panels Victoria (PPV) and the Administrative Review Tribunal (ART) speaking alongside a representative from the Judicial College of Victoria (JCV) who will speak about the education it provides to judical officers on this topic .
