About the Book:

Foreign Affairs in the Canadian Constitution provides a comprehensive examination of the constitutional foundations and evolution of Canada’s foreign affairs powers. Scott Fairley explores the relationship between federal executive power, the royal prerogative, and the constitutionally divided legislative powers of the federal and provincial governments. Drawing on key federal-provincial disputes, including conflicts over free trade in the 1980s and the Supreme Court of Canada’s consideration of federal climate change legislation, the book examines how foreign affairs powers have been understood and applied in practice. Fairley also places Canada’s constitutional framework in comparative perspective by examining Australia and the United States, ultimately arguing that constitutional evolution, governmental practice, and judicial interpretation have established foreign affairs as a constitutionally supported field of federal jurisdiction.

About the Speaker:

Dr. H. Scott Fairley is a partner at Cambridge LLP and Co-Chair of the firm’s International Arbitration Group. He holds a B.A. and LL.B. from Queen’s University, an LL.M. in International Legal Studies from New York University, and an S.J.D. in International and Constitutional Law from Harvard University. A member of the Ontario Bar and a Fellow of the Chartered Institute of Arbitrators, Dr. Fairley has extensive experience in constitutional, international, and arbitration law. He has represented government and private entities before courts at all levels in Canada, including the Supreme Court of Canada, and has acted as counsel and arbitrator in domestic and international proceedings. He has also held numerous leadership positions within the Canadian and international legal professions, including with the Canadian Bar Association, the Canadian Council on International Law, and the American Bar Association.

L’ouvrage Foreign Affairs in the Canadian Constitution offre une analyse approfondie des fondements constitutionnels et de l’évolution des pouvoirs du Canada en matière d’affaires étrangères. Scott Fairley y explore les liens entre le pouvoir exécutif fédéral, la prérogative royale et la répartition constitutionnelle des pouvoirs législatifs des gouvernements fédéral et provinciaux. S’appuyant sur des différends fédéraux-provinciaux importants, notamment les conflits relatifs au libre-échange dans les années 1980 et l’examen par la Cour suprême du Canada de la législation fédérale sur les changements climatiques, l’ouvrage analyse la façon dont les pouvoirs en matière d’affaires étrangères ont été compris et appliqués dans la pratique. À propos du conférencier :

M. H. Scott Fairley est associé chez Cambridge LLP et coprésident du groupe d’arbitrage international du cabinet. Il est titulaire d’un baccalauréat ès arts et d’un baccalauréat en droit de l’Université Queen’s, d’une maîtrise en droit international de l’Université de New York et d’un doctorat en sciences juridiques (droit international et constitutionnel) de l’Université Harvard. Membre du Barreau de l’Ontario et membre de l’Institut des arbitres agréés, M. Fairley possède une vaste expérience en droit constitutionnel, international et d’arbitrage. Il a représenté des entités gouvernementales et privées devant les tribunaux de tous les paliers au Canada, y compris la Cour suprême du Canada, et a agi à titre d’avocat et d’arbitre dans des procédures nationales et internationales. Il a également occupé de nombreux postes de direction au sein des professions juridiques canadiennes et internationales, notamment auprès de l’Association du Barreau canadien, du Conseil canadien de droit international et de l’Association du Barreau américain.
