Over the past several years, Colorado has adopted significant new protections for residential tenants and new requirements for landlords.
This class is designed to move beyond a list of all the new legal changes and focus on how Colorado’s landlord-tenant laws actually work in practice.
Real estate attorney, Greg Parham, and Property Manager, Kevin Mackessy, will focus on the following three areas of landlord tenant law with real life scenarios:
Warranty of Habitability
We’ll discuss Colorado’s expanded Warranty of Habitability requirements and, more importantly, what landlords should do when a tenant reports a problem. We’ll look at identifying potential habitability conditions, landlord response and remediation requirements, when relocation may be required, and how these rules apply to common maintenance situations.
Security Deposits
Security deposits continue to be a significant source of landlord-tenant disputes. We’ll cover Colorado’s limits on security deposits, pet deposits and pet rent; permissible deductions versus ordinary wear and tear; tenant walkthrough requirements; documenting deductions; and practical considerations when a tenant disputes a withholding.
Lease Renewals, Non-Renewals & No-Fault Evictions
A lease reaching its expiration date does not necessarily mean a Colorado landlord can simply require the tenant to leave. We’ll examine Colorado’s restrictions on terminating and declining to renew residential tenancies, including when a landlord may legally end a tenancy, applicable notice requirements, and the timing considerations landlords need to understand before making renewal decisions.
Practical Scenarios & Takeaways
Throughout the class, we’ll use practical examples to demonstrate how these laws affect everyday rental-property decisions. The goal is not simply to know that the law changed, but to understand what to do when an actual issue arises.
