Summary
In this workshop Charlotte John, barrister, will lead delegates through an interactive case study exploring what can be done to prevent and remedy financial abuse. The session is designed for STEP members advising elderly and vulnerable clients, executors, attorneys and deputies, and families, and for those handling litigation when things go wrong. The session will explore the following topics:
- Spotting the red flags of financial abuse.
- Capacity in context: applying the right tests to gifts, LPAs and wills.
- Court of Protection pathways: revocation of LPAs, appointment of deputies, authority to litigate and statutory wills.
- Predatory marriage: pre-emptive protections and the options if a marriage has taken place.
- Civil recovery routes: including setting aside transactions for undue influence or lack of capacity, the remedy of an account, personal and proprietary claims.
- Post‑death strategy: executor problems and evidence gathering.
- ADR and costs: timing of mediation, approving compromises, and managing costs risk.
The talk will start at 2.00 pm following a chance to network from 1.30 pm and will end at 5.00pm

CHARLOTTE JOHN is a Barrister at Gatehouse Chambers. Charlotte’s practice focuses on contentious private client and property litigation. She has particular expertise in disputes concerning the administration of estates and trusts, contentious probate, real property and Court of Protection property and affairs matters. Charlotte is an arbitrator and mediator and sits as a Deputy District Judge, including in the Financial Remedies Court and the Court of Protection. Charlotte is a contributor to Cohabitation Law & Precedents (Sweet & Maxwell), Family Court Practice (the Red Book, LexisNexis) and the Dictionary of TLATA and Inheritance Act Claims (Class Legal).
