About this Event

Speaker

Gislene Santos, philosopher, is a Black Women, wife, mother and ‘granddogmother' and an Associate Professor at the University of São Paulo (USP). She holds a Master's degree in Philosophy with a specialization in Epistemology of Psychology and Psychoanalysis, and a PhD in Psychology. Professor Santos teaches undergraduate courses in Public Policy Management at the School of Arts, Sciences and Humanities (EACH-USP) as well as at the Postgraduate Program in Law in the area of Human Rights at the Faculty of Law (FD-USP). Currently she coordinates the nPeriferias, Research Group on Peripheries of the Institute of Advanced Studies (IEA) of USP, and the USP Women's Human Rights Clinic. Her focus is on investigating race, gender and racism.

Abstract

Biases in judgment and decision-making processes have been the focus of research in recent decades and have become a challenge to be faced in Brazil since the production of the ‘Protocol for Trials with a Gender Perspective’ (2021) and the ‘Protocol for Trials with a Racial Perspective’ (2024) by the National Council of Justice (CNJ).

This presentation focuses on cases of women convicted of theft in the Sao Paulo Court of Justice (TJSP) from 2008 to 2022 and is based on the analysis of a 5% random sample taken of 4,695 decisions data-mined from the TJSP State. Expanding on the findings, Professor Santos will discuss discretionality in judiciary decision-making, beliefs in impartiality, and biases: How can fair trials be achieved considering all these factors?
