About this Event
Represent Yourself in the Family Courts MASTERCLASS - Mock Final Hearing
Is this learning event for me?
Has the removal of legal aid for Family Court cases left you with the daunting prospect of representing yourself? Are expensive solicitors’ bills beyond your means? Do you feel anxious at the thought of trying to navigate through a legal process you have no experience of? Are you asking yourself the same questions over and over again?
How will I get legal advice? Is it foolish to represent myself? What will the judge think? What if my ex has a really good solicitor? Where do I start with all of this? What do other people in my situation do? What do I say to CAFCASS?
If you’re asking yourself these questions, then this learning event is for you. This unique day course provides affordable trustworthy legal help and advice to people going to Family Court to settle disputes concerning their children.
What will I learn?
Final Hearings come in three types, a Children Final Hearing, a Financial Final Hearing, and a fact Finding Hearing. This mock trial will be a Fact Finding Hearing, simply because all three follow the same pattern and same method of preparation, but the Fact Finding has a couple of additions, so the contents of the course will be applicable to all three.
The differences will be brought to your attention throughout the day, but they essentially relate to the topic, rather than content of the Hearing.
On the day we will analyse the Statement you have been provided with and highlight the issues, write a Case Theory and a Closing Submission. We will then look at how you would respond to a Statement using your written statement and look at evidence. You will have a range of evidence and I will explain the advantages and disadvantages of the samples. I will then provide you with a Statement in response to the one you were provided with, written by me as a guide. I will explain Cross Examination and we will then work together to create cross examination questions for two lines of evidence.
You will then work individually, as well as a group to prepare your own cross examination and then we will go through a full hearing, hear the evidence and cross examination, and then critique what we have seen.
How will it help me?
Most people go on from this event to successfully prepare and manage their final hearing preparation without further assistance. Your host, Simon Walland, with his expansive legal knowledge and over twenty years of Family Court experience right up to the High Court, can give you invaluable insight into how the Family Court will deal with your case. In addition, Simon is a proven educator who has taught at universities and charities and an expert when it comes to simplifying the complexities of legal processes, key legal terms and relevant laws. You’ll also take away a raft of useful information, practical guidance and sample documents that you can use to manage your own case with confidence.
Is further help and support available?
Sometimes extra help is needed. Sometimes a case is more complex. Sometimes, preparing for a hearing isn’t someone’s best skill. Don’t worry, that’s not unusual.
