Founded in 1964 as Goldberg-Zoino & Associates, Inc., a soils and foundations specialty consultant, GZA GeoEnvironmental, Inc. has grown into a full-service company providing its clients with a wide range of geotechnical engineering and environmental consulting services. The GZA Lecture was established with the ASCE Metropolitan Section Geotechnical Group in 2010 to promote developments and advances in the fields of geotechnical and foundation engineering and to explore technologies developed within our industry to meet the urban geotechnical, foundation, and construction challenges.

LECTURE SUMMARY

The observational approach in subsurface design and construction has been utilized with success for over 60 years on a number of underground projects. The essence of the approach is the recognition that subsurface conditions encountered during construction may result in the need to modify initially planned permanent works design and construction means/methods approaches.

In some instances, opportunities to utilize the observational approach are constrained by contractual risk allocation terms and project delivery approaches.

Early contractor involvement approaches on subsurface projects provide increased opportunities for timely alignment of contractual risk allocation with design and construction modifications implemented through the observational approach. This presentation will explore those opportunities.


THE SPEAKER:

David J. Hatem is a Boston-based Partner with MG+M The Law Firm, and a nationally recognized attorney whose practice specializes in representing engineers and architects and advising professional liability insurance underwriters on project-specific insurance matters. Throughout his career he has authored and edited numerous articles and publications in his field.

He has authored and edited numerous articles and publications in his field of expertise, including:

• Hatem, D.J. and Gary, P. 2020. Public-Private Partnerships and Design-Build: Opportunities and Risks for Consulting Engineers, 3d ed., American Council of Engineering Companies, Washington, D.C.

• Subsurface Conditions: Risk Management for Design and Construction Management Professionals (1998)

• G. Brierley, D. Corkum, and D. Hatem, Design-Build Subsurface Projects, Second Edition (Society for Mining, Metallurgy and Exploration, Inc. 2010)

• D.J. Hatem & D. Corkum eds., Megaprojects: Challenges and Recommended Practices, ACEC (2010)

He is author of Project-Specific Professional Liability Insurance on Design-Build and Public-Private Partnership Projects in North America: A Path Forward (May 3, 2022). In addition, he has written and published numerous articles and papers on these subjects, most recently “Recalibrating and Improving Design-Build on Public Infrastructure Projects” American Bar Association, September 2022. Most recently, he has been a member of the writing committee for Geotechnical Baseline Reports Suggested Guidelines, ASCE Manuals and Reports on Engineering Practice No. 154 (R. Essex, 2022); and served as a legal reviewer/resource for Geotechnical Baseline Reports: A Guide to Good Practice (CIRIA C807, 2023). In Canada, David is a member of the Tunnelling Association of Canada and presented multiple papers at the TAC Annual Conference over the last several years.

Since 1988 David has continuously served as counsel for the American Council of Engineering Companies of Massachusetts (ACEC/MA), while also teaching Legal Aspects of Civil Engineering at Northeastern University Graduate School of Engineering.
