About this Event
Employers are usually confident in handling dismissals linked to redundancy, performance shortcomings, or misconduct. Challenges arise, however, when they need to end employment for someone who is meeting expectations, has not breached any rules, and whose job still exists.
In these more complex scenarios, the category of “some other substantial reason” (SOSR) can provide a lawful basis for dismissal. Because SOSR is intentionally flexible, it enables employers to deal with atypical or sensitive circumstances that do not fall neatly within the standard grounds for dismissal.
Using case law examples and attendees’ own insights and experience, we will explore:
- What exactly is SOSR?
- When might a reason for dismissal amount to SOSR?
- Do you have to follow a fair procedure?
- Does the ACAS code of practice apply?
- How does SOSR interact with other fair reasons for dismissal?
