The Supreme Court recently held in Skrmetti that a state ban on gender-affirming medical care for minors does not constitute discrimination on the basis of sex or transgender status. The Court is also set to decide on another case this term concering transgender athletes. Ths discussion will examine the contour's of the Court's emerging trans-related constitutional jurisprudence—where it stands, where it may be headed, and what is at stake.
