Managing employee leave and accommodation requests requires understanding complex, overlapping regulations that vary by jurisdiction and situation. This session provides clarity on federal leave laws and ADA requirements, helping HR professionals make compliant decisions while supporting business operations.
Three Takeaways: Understanding Leave Law Intersections
Participants will learn how FMLA, ADA, state leave laws, and company policies interact and overlap, including how to determine which laws apply in specific situations, calculate leave entitlements when multiple laws are in play, and manage the administrative requirements for each. The session covers common scenarios where leave laws intersect, such as pregnancy, chronic conditions, and workplace injuries.
ADA Interactive Process and Reasonable Accommodations -Attendees will gain a practical framework for engaging in the interactive process, evaluating accommodation requests, determining what constitutes ""reasonable"" versus ""undue hardship,"" and documenting the accommodation process. Topics include how to handle medical documentation, when to request fitness-for-duty certifications, and managing situations where the requested accommodation cannot be provided.
Compliance Documentation and Risk Management - Participants will receive templates and checklists for tracking leave requests, managing intermittent leave, maintaining required notices and postings, and creating documentation that demonstrates compliance. The session addresses common pitfalls such as improper denial of leave, failure to engage in the interactive process, and retaliation claims."
