FORCE MAJEURE Should the event or the production of ‘Josie's Jamishness’ be delayed or prevented by reasons including acts of government at the exclusion of any and all decree(s)/decision(s)/notice(s) or regulation or interdiction declared or undeclared risks, riots, strikes, lockouts, lockdowns, city or state shutdown, government shutdown, civil commotion, hurricane, earthquake, floods, fire, official declaration of plague infection, virus, disease, pandemic etc. war and/or hostilities and/or consequences, or by the consequences of such occurrences or for any other cause not the cause of ‘Josie's Jamishness’, ‘The Bands’ will notify participants within seven (7) working days from the date of occurrence of event by e-mail, website, social media or phone. If the event is prevented by any of the above causes, ‘The Bands’ will not be held responsible and in the case of a FORCE MAJEUR there will be No Refunds. If event is cancelled due to M3 Studios, it is at the fault of M3 Studios and not ‘Josie's Jamishness’. Therefore, ‘Josie's Jamishness’ will not be held responsible and will not issue any refunds unless event is cancelled 4 months prior to event date.

INDEMNIFICATION You agree to indemnify, defend and hold harmless ‘Josie's Jamishness’, its Officers, directors, employees, agents, section leaders and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Sites or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. ‘Josie's Jamishness’ reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with ‘Josie's Jamishness’ in asserting any available defenses.

LIABILITY DISCLAIMER The information, software, products, and services included in or available through the site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. ‘Josie's Jamishness’ and/or its suppliers may make improvements and/or changes in the site at any time. ‘Josie's Jamishness’ and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided “as is” without warranty or condition of any kind. ‘Josie's Jamishness’ and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement. To the maximum extent permitted by applicable law, in no event shall ‘Josie's Jamishness’, inc and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequental damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the site, with the delay or inablilty to use the site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the site, or otherwise arising out of the use of the site, whether based on contract, tort, negligence, strict liability or otherwise, even if ‘Josie's Jamishness’, inc or any of its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the site, or with any of these terms of use, your sole and exclusively remedy is to discontinue using the site.

In consideration of the ‘JOSIE'S JAMISHNESS’ consent to allow me to participate in any or all recreational or other activities related to ‘JOSIE'S JAMISHNESS’, I hereby knowingly, freely and voluntarily agree to waive, release and discharge any and all claims for damages for death, personal injury, or property damage that may have, or that may subsequently accrue to me as a result of my participation in recreational or other activities offered, afforded, or sponsored by ‘JOSIE'S JAMISHNESS’.

Conduct: I agree to follow all instructions, procedures, measures, and directions given to me by ‘JOSIE'S JAMISHNESS’ or any of its staff or representatives and understand that my failure to do so may result in property damage or injury or death to me or to a third party. I understand that my invitation to participate in recreational or other activities on the Properties may be revoked at any time for any reason by ‘JOSIE'S JAMISHNESS’ or any of its agents, managers, employees, or representatives.

TERMINATION / ACCESS RESTRICTION ‘Josie's Jamishness’ reserves the right, in its sole discretion, to terminate your access to the Sites and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Sites. Use of the Sites are unauthorized in any jurisdiction that does not give effort to all provisions of these Terms, including, without limitation this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and ‘Josie's Jamishness’ as a result of this agreement or use of the Site. ‘Josie's Jamishness’ performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of ‘Josie's Jamishness’ right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to gathered by ‘Josie's Jamishness’ with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effort. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and ‘Josie's Jamishness’ with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and ‘Josie's Jamishness’ with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

CHANGE TO TERMS ‘Josie's Jamishness’ reserves the right, in its sole discretion, to change the Terms under which ‘the Sites’ is offered. The most current version of the Terms will supersede all previous versions. ‘Josie's Jamishness’ encourages you to periodically review the Terms to stay informed of our updates.

COVID-19 SAFETY ACKNOWLEDGEMENT LIABILITY WAIVER AND RELEASE

COVID-19 SAFETY INFORMATION: While participating in events held or sponsored by Josie’s Jamishness, including events hosted by member bands, consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Josie’s Jamishness has put in place preventative measures to reduce the spread of COVID-19. However, Josie’s Jamishness cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Josie’s Jamishness events. By attending a Josie’s Jamishness event, you certify that you do not fall into any of the following categories:

1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

DUTY TO SELF-MONITOR: Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact Josie’s Jamishness at [email protected] if he/she experiences symptoms of COVID-19 14 days prior to participating or volunteering with Josie’s Jamishness event.

LIABILITY WAIVER AND RELEASE OF CLAIMS: I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with Josie’s Jamishness, and I willingly engage in Josie’s Jamishness 2021 events and/or other related activities (the “Activity”).

Release and waiver. I hereby release, waive and forever discharge any and all liability, claims, and demands of whatever kind or nature against Josie’s Jamishness and its affiliated partners and sponsors, including in each case, without limitation, their directors, officers, employees, volunteers, and agents (the “released parties”), either in law or in equity, to the fullest extent permissible by law, including but not limited to damages or losses caused by the negligence, fault or conduct of any kind on the part of the released parties, including but not limited to death, bodily injury, illness, economic loss or out of pocket expenses, or loss or damage to property, which I, my heirs, assignees, next of kin and/or legally appointed or designated representatives, may have or which may hereinafter accrue on my behalf, which arise or may hereafter arise from my participation with the activity.

ASSUMPTION OF THE RISK. I acknowledge and understand the following:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;

2. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID19, even if arising from the negligence or fault of the Released Parties; and

3. I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

MEDICAL ACKNOWLEDGMENT AND RELEASE. I acknowledge the health risks associated with the Activity, including but not limited to transient dizziness, lightheaded, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Activity, I will discontinue my participation immediately and seek appropriate medical attention. I do hereby release and forever discharge the released parties from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my participation in the activity.

As a participant, volunteer, or attendee, You recognize that your participation, involvement and/or attendance at any Josie’s Jamishness 2021 event or activity (“Activity”) is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing or participating in the Activity, You acknowledge and assume all risks and dangers associated with your participation and/or attendance at the Activity, and You agree that: (a) Josie’s Jamishness, including its member bands (b) the property or site owner of the Activity, and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the “Released Parties”), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of your participation in, attendance at, and/or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the “Released Claims”). By attending and/or participating in the activity, you are deemed to have given a full release of liability to the released parties to the fullest extent permitted by law.
