TOPIC:

More and more often in court, investigators and uniformed officers, especially in small jurisdictions, are being challenged about their expertise, experience, and if they have any kind of training or certification in certain areas of law enforcement.

The area of interviews and interrogations has been a huge topic of debate in the news and on social media. Public perception has swayed to have many citizens believe that police are untrustworthy and manipulate false confessions from innocent people. The only way to survive this relentless attack, which is often rooted in misinformation, is to get better and more professional at what we do.

The class objectives are:

1) The difference between an interview and an interrogation.

2) The student will be introduced to typical interview settings, and how an investigator can use the physical setting of the interview to his/her advantage.

3) Witness or suspect? Sometimes the line is blurred, and sometimes one becomes the other. Learn how to discern and define to whom you are talking.

4) Body language- Students will discuss and understand the importance of reading body language, and video examples will be given.

5) The students will understand the ramifications of the Fifth Amendment, and what Miranda really means. Exceptions to Miranda requirements, and different examples of a “police-dominated atmosphere” will be discussed.

6) The students will understand the phases and progression of an interview; when and how to bring the subject to a place of comfort enough to confess.

7) Interviewer demeanor and behavior (such as taking notes) will be discussed throughout the class.

8) Finalizing and documenting a confession, and making it “bulletproof” for court.

SUMMARY: The student who can conduct an effective, lawful, defensible interrogation and obtain a confession—as well as conduct more thorough and productive witness interviews—will close more cases and win them in court.


INSTRUCTOR: Ramesh Nyberg is a retired police veteran of a 27-year law enforcement career with the Miami-Dade (FL) Police Department. He spent 21 of those years as a Homicide Investigator, working on death investigations of all kinds. He has traveled all over the U.S. and to several countries to interview witnesses and suspects. Ramesh was also a member of the MDPD Homicide’s “Cold Case” Squad. Det. Nyberg has authored hundreds of articles for Police, Police and Security News, Law and Order, Law Enforcement Technology, and the Miami Herald. He was an instructor at Miami-Dade’s Training Bureau, where he taught Homicide Investigation, Interviews and Interrogations, and Major Case Management. He retired in 2006, and taught Criminal Justice at a Miami high school, before opening his own private investigation agency.
