ITS ALL ABOUT DISMISSALS AND HOW TO AVOID UNFAIR DISMISSAL CLAIMS!
Employment Law Update: The first part of the session will be an employment law update focussing on recent case law decisions in the area of unfair dismissal providing valuable lessons about dealing with dismissal situations.
Mock Disciplinary hearing: In the second part of the session you will be given the opportunity to be fully immersed in a disciplinary procedure. The mock Disciplinary will be presented by Keeley Baigent of ksabLAW and Aimee Johns of EMW Law. You will decide the outcome of and identify flaws in the LIVE disciplinary hearing that you observe. As part of the session you will learn:
- When suspension is compliant wih ACAS Guidance;
- What amounts to a reasonable investigation;
- The importance of correctly drafting the specific allegations against the employee; and
- What factors need to be considered in reaching a reasonable decision to dismiss.
As the law changes in January 2027 reducing the qualifying length of service for an employee to bring an unfair dismissal claim to 6 months and the cap on unfair dismissal compensation is removed now more than ever an employer needs to understand how to conduct a fair and reasonable disciplinary procedure.
