Businesses find themselves wanting to hire contractors, instead of employees. No payroll obligations? No holiday pay obligations? Potentially no termination pay obligations? Sign me up! In reality, however, it can be quite different. Even if you a call a worker a “contractor”, the CRA, the Ministry of Labour, etc. can still come around and say that you are liable for taxes, remittance, penalties, fines, unpaid overtime pay, unpaid vacation pay, etc. as you have mislabeled an employee as a contractor. In fact, even the worker themselves can suddenly do an about face and claim that you mislabeled them.

Before entering into a relationship with a contractor, it is important to confirm that you not mislabeling an employee and it is also important that you properly protect the company with an enforceable written contractor agreement.
