PLEASE READ THESE TERMS CAREFULLY BEFORE AGREEING TO THEM AND ATTENDING THE EVENT, ESPECIALLY PARAGRAPH 6 (OUR LIABILITY TO YOU), PARAGRAPH 8 (HEALTH WARNING), PARAGRAPH 9 (HOW WE MAY USE YOUR PERSONAL INFORMATION) AND PARAGRAPH 10 (FILMING AT THE EVENT) .

1. These terms

1.1 These terms and conditions as may be amended and updated from time to time (and any other documents referred to in these terms and conditions) (Terms), set out the terms and conditions for application to and participation in the free Courtney Black Bootcamp that is scheduled to take place on 2 July 2022 from 12.00pm to 3.30pm at the London Marathon Community Track (the Event).

1.2 By registering for the Event, you accept these Terms and agree to comply with them.

1.3 The Event is organised by Courtney Black App Ltd, a company registered in England and Wales. Our company registration number is 12458873 and our registered office address is 6-7 Waterside Station Road, Harpenden, England, AL5 4US (we, us, our).

1.4 You can contact us by writing to our team at [email protected]. If we have to contact you, we will do so by email.

1.5 For information about the accessibility of the venue, please visit the venue’s website. The venue’s website can be accessed here. If you have any further questions in relation to accessibility, please contact us using the email address provided at paragraph 1.4 above.

1.6 Any words following the terms including, include, in particular, for example or any similar expression shall be interpreted as illustrative and will not limit the sense of the words, description, definition, phrase or term preceding those terms.

2. Participation in the Event

2.1 When you register for the Event you confirm that you:

(a) are 18 years old or over; and

(b) accept and agree to these Terms.

2.2 This is a free Event and tickets will be allocated on a first come, first served basis. Upon registering for the Event, you will receive a ticket via email (Ticket). This ticket is confirmation that you have a place at the Event and may attend it.

2.3 You must be able to provide us with a copy of your Ticket and proof of age on the day. We reserve the right to refuse you entry to the Event if you do not have a valid Ticket and/or you are under eighteen (18) years of age.

2.4 Participation in the Event is personal to you and you are strictly prohibited from swapping, selling or transferring your Ticket.

2.5 You should inform us immediately by emailing [email protected] if you are no longer able to attend the event for any reason.

2.6 A reference in these Terms to “Participant” is to any attendee of the Event, including you and any additional quests or attendees as relevant.

3. Event capacity

3.1 There is a capacity limit of one thousand (1000) Participants for the Event. It is important for health and safety reasons that the Event does not exceed its capacity.

3.2 The doors to the venue will open for the purposes of the Event at 11.20am. The Event will start at 12.00pm.

3.3 We reserve the right to reduce or alter the Event capacity for whatever reason, [including to accommodate any unexpected complications on the day that may impact you]. 

3.4 You and all other Participants must follow our instructions and decisions, and the instructions of our representatives and any venue staff (including if you are late to, or otherwise unable to participate in, the Event). For health and safety reasons it is possible that if you are late arriving at the Event, you will not be permitted to take part.

3.5 The rules and policies of the venue will also apply to you. The venue’s website can be accessed here.

4. Conduct at the Event

4.1 You must follow these Terms and any other rules, instructions or regulations displayed or given before or on the day of the Event by us, our representatives, venue staff [and/or other officials], including those relating to your health and safety and the health and safety of other Participants. 

4.2 You agree that you will:

(a) act responsibly and sensibly at all times;

(b) not use aggressive or abusive language towards us, our representatives, venue staff, other Participants and/or any other persons at the Event;

(c) avoid behaving in a way which may cause injury or harm to us, our representatives, venue staff, other Participants and/or any other persons at the Event;

(d) avoid behaving in a way which may cause offence or damage our reputation.

4.3 We reserve the right to require you to leave the Event if you do not adhere to these Terms. 

5. Our rights to cancel and/or reschedule the event

5.1 We do not have to hold the Event and may at our sole discretion suspend access to, cancel or reschedule the Event, at any time and for any reason.

5.2 If we need to change the location, date or time of the Event, or cancel the Event entirely we will notify you of this change.

5.3 We will have no responsibility for any losses, expenses or costs incurred as a result of any rescheduling or cancellation, (including any travel, subsistence or accommodation costs).

6. Our responsibility for loss or damage suffered by you

6.1 You enter and attend the Event entirely at your own risk.

6.2 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are only responsible for loss or damage you suffer that is a foreseeable result of our breaching these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made (i.e. when you entered into a contract with us under these Terms), both we and you knew it might happen.

6.3 To the maximum extent permitted by law, in the absence of any negligence or other breach of duty by us, we shall not be liable for (and we exclude any liability for) any injury, damage or loss to you and/or your property that might occur as a result of your participation or attendance at the Event.

6.4 We shall not be liable for any indirect, consequential or special loss or damage, such as loss of enjoyment or travel or accommodation costs, even if we are aware of the possibility of such damage or loss and regardless of whether the loss or damage would arise in the ordinary course of events or is reasonably foreseeable.

6.5 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; fraud or fraudulent misrepresentation; and for any other matter which it is not possible to exclude or limit liability for (including your statutory rights and rights as a consumer).

6.6 The event is not for your commercial use and/or business purposes. If you use and/or attend the Event for commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

7. Indemnity

7.1 You shall indemnify us (i.e. compensate us) on demand against any and all claims, actions, proceedings, demands, damages, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or incurred by us as a result of or in connection with your breach of these Terms.

8. Our health warning

8.1 Bootcamp exercise is physically challenging and carries with it risks that we cannot entirely eliminate. These include the risk of personal injury, such as pulled muscles and more severe injuries.

8.2 You acknowledge and agree that that Event is non-competitive and your attendance at the Event and physical activity in general presents a risk of physical injury, especially if you already have injuries or underlying health issues. You should ensure that you adapt any physical activity (and/or changes to your diet) before and during the Event to reflect your level of personal fitness and to account for any injuries or illnesses that you have.

8.3 At the Event, we may, during Q&A sessions, promote physical activity and a healthy diet. Any information provided by us before, during or after the Event is provided for information purposes only and is not intended to be taken as medical advice. We are not healthcare professionals and we do not offer bespoke individual advice on which you should rely. Before engaging in any physical activity or making any changes to your diet or lifestyle, you should seek advice from a doctor and/or physio and/or nutritionist and/or dietician (as relevant).

8.4 If you have any concerns regarding your health or fitness, you should not attend the Event. If any such concerns arise during the Event, or if at any stage you feel uncomfortable at the Event, you should stop what you are doing to avoid potential injury, and you should consider seeking medical attention from a healthcare professional. You acknowledge and agree that you are responsible for monitoring your own physical condition prior to and during the Event.

8.5 You acknowledge and agree that it is your responsibility to ensure that you are sufficiently fit and healthy to take part in the Event. If you are unsure of your physical ability to take part in the Event, currently have any underlying health issues, are pregnant or breastfeeding, or have recently given birth or had surgery you should not attend the Event without first consulting appropriate healthcare professionals and experts (e.g. a doctor and/or a physio) to assess whether it is safe for you to take part.

8.6 We reserve the right to refuse entry to the Event, if for whatever reason we consider you to be unfit to take part. We may also ask you to stop participating in the Event during the Event if we have any concerns about your safety.

8.7 You consent to medical assistance and/or medical care being given to you in the case of any illness, injury or an emergency situation that occurs during the Event.

9. How we may use your personal information

9.1 We will collect your personal information (including full name, address, age and contact information) when you register for the Event, as well as on the day of the event (for example, you may be asked to provide contact details upon attendance, and you may feature in recordings or livestreams of the event). Your personal data is collected for the purpose of organising, staging and administering the Event, as well as making recordings of the Event available via livestream and, at our discretion, making recording of the Event available via our websites or other means.

9.2 We will always handle your personal data in compliance with applicable laws. For more information on how we use personal data, please see refer to our privacy policy (https://www.courtneyblack.co.uk/privacy-policy) and cookie policy (https://www.courtneyblack.co.uk/cookie-policy), which also contain information on who to contact with any questions you may have.

9.3 We process the personal data described above on the legal basis of fulfilling a contract with you (i.e. our endeavours to provide you with access to the Event) and also on the basis of our legitimate interest to host the Event safely, improve any future Events and make the livestream and any recordings of the event available. You have various rights in relation to our processing of personal data, which are set out in our privacy policy (https://www.courtneyblack.co.uk/privacy-policy).

9.4 In the case of an emergency, we may also pass personal details provided when registering for the Event to the emergency services or health care professionals, and also use them for the purposes of contacting your emergency contact.

9.5 First aid facilities will be provided at the Event. If you are treated by medical providers at the Event, your details may be passed on to us only for health and safety purposes and to fulfil our legal obligations (including those under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995). All accident details will be held by us in line with statutory requirements and for the purposes of our health and safety risk assessments. 

9.6 Following your registration and/or after the Event, we may contact you to request feedback on the Event, and to give you the opportunity to opt in to marketing from us, including in relation to the Courtney Black mobile app (CB App) and the Courtney Black website www.courtneyblack.co.uk (CB Website) and details of future Events. We will always ensure any marketing consents you give to us are collected in accordance with applicable law and in accordance with our Privacy Policy (https://www.courtneyblack.co.uk/privacy-policy). Please note that additional terms and conditions will apply to your use of the CB App and CB Website.

10. Filming at the Event

10.1 We (or authorised third parties) may film and/or photograph the Event, which may include footage of Participants (Event Content) and we may use Event Content for our commercial purposes, including: (i) to livestream the Event to the public; (ii) to publicise the Event or similar events; (iii) to provide recordings of the Event as video-on-demand content to the public; and (ii) for any of our commercial partners to publicise their involvement and/or association with the Event.

10.2 You must only register if you are over the age of 18 and are happy for your image/likeness being used for the purposes described in these Terms. By registering for the Event, and in return for your Ticket (which you acknowledge as a sufficient benefit to you), you hereby:

(a) consent to being photographed or filmed or depicted by or for us in connection with the Event, and grant to us the right to use (and to authorise others to use) your likeness, voice and any other content captured of you at the Event for the purposes set out in paragraph 10.1;

(b) waive, and agree not to assert, any moral or other non-transferable rights under the present or future laws of any jurisdiction and grant us the right (itself or authorising others) to edit, copy, adapt, translate, add to, delete or otherwise modify the Event Content as we see fit;

(c) grant and confirm every consent under any laws now or in the future in force in any jurisdiction which may be required for the fullest use of the Event Content without further liability or acknowledgement to you; and

(d) acknowledge and agree that: (i) neither we nor any third party is under any obligation to produce and/or exploit the Event Content; (ii) we cannot control the way in which your inclusion in the Event content, once communicated to the public, is used or reported, and we are under no obligation to try to do so; and (iii) you are not a signatory to any applicable union, guild, collective bargaining institution, association, professional body or other similar organisation, and any depiction of you in the Event Content is not subject to any additional rules, regulations, restrictions or orders,

in each case, (i) throughout the universe, (ii) for the full period during which such rights subsist (including any renewals, revivals, reversions and extensions of the same) and thereafter (to the fullest extent possible) in perpetuity, and (iii) via any and all media (now or in the future known).

10.3 You may take your own photographs and/or video footage of the Event for your own personal use (Your Content), including posting on social media. When doing so, please be respectful of other Participants. You are solely responsible for all of Your Content and we will not be liable for any losses related to Your Content. If you tag us on social media or otherwise send Your Content to us, we may re-share, promote or otherwise use that content for our own commercial purposes (including promoting the Event, future Events and our other services). In so doing, you grant to us a worldwide, perpetual, irrevocable, assignable, sub-licensable, royalty-free and non-exclusive licence to use Your Content and hereby grant all such consents and waivers as may be necessary for us to use Your Content. You shall not record, take photographs or transmit any sound or image of the Event for any commercial purpose.

11. Other important terms

11.1 We may change these Terms. We may need to change these Terms to reflect changes in law, regulatory requirements or best practice or to deal with changes to the Event. Where such changes are material we will endeavour to give you at least 14 days’ notice of any change via email, where possible. If you do not accept the notified changes you will no longer be able to attend or participate in the Event.

11.2 Nobody else has any rights under these Terms. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

11.3 If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.4 Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

11.5 Which laws apply to these Terms and where you may bring legal proceedings. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

Rules:
• You must act responsibly and sensibly at all times.
• You must not participate if you are under the influence of alcohol or non-prescription drugs.
• If you are unsure of your physical ability to take part in the Bootcamp, currently have any underlying health issues, are pregnant or breastfeeding, or have recently given birth or had surgery you should not attend the Bootcamp without first consulting appropriate healthcare professionals and experts (e.g. a doctor and/or a physio) to assess whether it is safe for you to take part.
• You are responsible for monitoring your own physical condition prior to and during the Bootcamp.
• You must follow any safety warnings or instructions displayed or given to you by us, our representatives and venue staff.
• We are not healthcare professionals and are not qualified to express an opinion that you are fit to safely participate. You must obtain professional or specialist advice from your doctor before participating.
In the absence of any negligence or other breach of duty by us, participation in the Bootcamp is entirely at your risk.
Please note: this bootcamp is a free event which will be filmed and live streamed. Before signing up for this event, please make sure that you are happy that you may be featured in our livestream and, potentially, in recordings of the event.
