� ENOUGH IS ENOUGH – VOTE NO ON ITEM 22! Good Neighbors protect water! The City of Corpus Christi shouldn’t be Judge, Jury, and Beneficiary over our water-below are some bullet points to help you with tomorrow's speech.
Tomorrow, the Corpus Christi City Council will vote on Item 22, authorizing the city’s Aquifer Storage and Recovery (ASR) Conservation District to petition to pull more land into its control.
This is not routine business — it’s an unethical, conflicted, and unlawful power grab designed to sidestep the citizen-led petition for the Nueces Groundwater Conservation District (NGCD).
We need a full room and a strong voice from landowners, neighbors, and concerned citizens to tell council:
� Stop this end-around. Respect the law. Respect the people.
� WHEN & HOW TO SPEAK
� Arrive early!
The meeting begins at 11:30 a.m. Tuesday, October 21, at Corpus Christi City Hall (Council Chambers).
Public comment for specific agenda items (like Item 22) happens before the item is voted on.
If you want your comments heard while the council is still deciding, just be inside the chamber before Item 22 is called.
� When the Mayor announces public comment for Item 22, the public will be invited to speak. At that time, simply walk to the podium, state your name, and—if you live within the city—say which Corpus Christi council district you live in before giving your remarks (up to 3 minutes). If you live outside the city limits, just state your name and “Nueces County” before sharing your remarks (up to 1 minute).

� If you absolutely can’t make it earlier in the day:
There’s a second public comment period at 5:30 p.m. for agenda or city-related items in general.
To speak at the 5:30 p.m. General Public Comment session, register through the online sign-in page or in person at the kiosk inside City Hall.
Registration will begin Monday at 8:00 a.m. and end Tuesday at 4:00 p.m. on council meeting weeks.
� Registration is not required to speak on a specific agenda item (like Item 22) when it is being considered.

� WHAT TO SAY
You don’t have to be a lawyer or expert.
Write your remarks in your own words, from your own perspective — as a landowner, businessperson, parent, or neighbor.
Below are bullet points to help you build your speech.
Pick the few that matter most to you — the goal is for everyone to sound different but united.
� CONFLICTS OF INTEREST
The ASR board is appointed by this council and made up entirely of city employees.
That means the city is petitioning itself.
It’s a textbook conflict of interest and violates the spirit of Texas Water Code §36.321.
When regulators and the regulated are the same people, there’s no accountability or independence.
� LEGAL PROBLEMS
Texas Water Code §36.321 allows landowners to petition for inclusion — not cities to petition themselves.
The city’s dual role as applicant and approver violates due process and the common-law rule of impartial tribunal.
The Nueces GCD petition is already pending at TCEQ — this “ASR” petition interferes with that process and could be void or voidable later.
The city’s petition could also be challenged as arbitrary and capricious under Texas Government Code §2001.038 (unlawful agency action).
� VIOLATION OF TEXAS LOCAL GOVERNMENT CODE §171
Chapter 171 prohibits city officials and employees from participating in decisions where they or their employer have a substantial interest.
The ASR board is made up of city employees appointed by this council, and the city itself is the petitioner.
That means city officers are acting on both sides of this petition — as applicant and approver.
This is a clear violation of §171.002 and §171.004, creating a conflict of interest that can invalidate the vote and even trigger criminal penalties.
Passing this resolution would not withstand a legal challenge — it violates both the letter and intent of Texas Local Government Code §171.
� PURPOSE OF A GCD
Groundwater Conservation Districts exist to protect, preserve, and conserve groundwater.
The city’s proposal does none of those — it’s about control, not conservation.
Real protection requires independent, local oversight — not a city-run board stacked with insiders.
� FOLLOW THE MONEY
This is about power and revenue, not water stewardship.
The city wants to control permits, pumping limits, and data.
It gives them economic leverage over rural residents and private well owners.
Allowing the same entity to sell water and regulate wells is a monopoly in disguise.
� BROKEN PROMISES
At the city’s Water Workshop a few weeks ago, staff talked about holding a town hall with affected residents.
That never happened.
Instead, they’re moving forward behind closed doors — no town hall, no notice, no transparency.
This is an end-around, plain and simple.
� LOCAL CONTROL
Rural landowners have managed this water responsibly for generations.
The NGCD was formed to ensure local decision-making, not city dominance.
The city’s move strips control from the people who actually live over the aquifer.
� BE A GOOD NEIGHBOR
The City of Corpus Christi should act like a good neighbor, not an empire builder.
Good neighbors respect boundaries, listen, and work together — not make power grabs.
This resolution does not protect water. It protects power.
� WHAT TO ASK THE COUNCIL
• Vote NO on Item 22.
• Stop this conflict of interest and protect public trust.
• Let the TCEQ review the pending NGCD petition first.
• Show that Corpus Christi City Council still values transparency and good governance.
