Although tort litigation in parent-company home states has become a pathway for addressing human rights and environmental harms, PRILβs procedural structure β including jurisdictional hurdles, rigid choice of law rules, and doctrines such as forum non conveniens β functions as a gatekeeping system that rarely allows claims to advance to the merits. This talk examines whether private international law (PRIL) can serve as an effective mechanism for corporate accountability in cases involving transnational mining companies operating in the Global South.
