What we’ll cover
This seminar covers avoiding contract pitfalls, proving delays, handling Extensions of Time and Loss & Expense, manage damages, and keeping records that win.
- Contract & notice traps that cost entitlement. Conditions precedent, time bars, amended EOT triggers, concurrency wording, and main contract/subcontract gaps that block recovery.
- Proving delay: programme credibility, criticality and causation (made simple). What decision-makers expect to see, selecting appropriate delay analysis methodologies and how to prove delay without drowning in analysis
- EOT vs Loss & Expense: getting both right. How to progress and present time and money entitlements correctly (and what changes in NEC contracts where they’re assessed together).
- Assessment and follow-up. What a good EOT assessment looks like (whether you are requesting one or preparing it), what should be recorded, and how to follow up if the claim isn’t dealt with properly.
- Delay damages and LD exposure. Liquidated vs unliquidated damages, common pitfalls, why securing the right EOT position matters, and how delay liability can be passed down the chain.
- Records that win. What “good” looks like in the real world and ensuring time spent on producing records achieves results and supports down-the-line recovery.
Attendees will receive example templates and flowcharts based on commonly used standard forms.
This seminar will be relevant for contractors, subcontractors, employers and consultants, including directors, commercial managers, project managers, quantity surveyors, contract administrators and in-house counsel. We will be focussing on JCT and NEC principles.
