The 2026 Arizona Territorial Justice Forum will be discussing the 1881 dispute between Tombstone Mill & Mining Co, owners of the Good Enough Mine, and the Way Up Mining Co.,
over extra-lateral or "Apex" rights.
The General Mining Law of 1872 gave owners of mineral veins that apexed on the surface of a vein and ran underground beneath the sidelines of an adjoining claim the right to pursue minerals into the subsurface of the adjoining claim. Litigation over such cases usually involved detailed expert testimony by geologists such as William Phipps Blake and John Adams Church.
