In response to ongoing community conversations and a noticeable trend unfolding across the Pacific and beyond, there emerges a pivotal moment for Creatives to recognize the importance of wills and bequests.

Understanding these legal responsibilities and the ramifications of registering original works within music and art service frameworks, which have historically been plagued by unethical and inequitable practices, is paramount for ensuring the smooth transition of creative assets to whānau, and for facilitating an equitable distribution of an artist's body of work.

The untimely departure of community members underscores the urgency of learning from historical precedents.

"In fact, the real reason why artists like Prince and Aretha Franklin die without a will has less to do with the artist failing to act and more to do with how legal, tax, financial and other professional advisors address the issue.
Artists don’t just leave an estate, they leave a lasting legacy, which necessitates a legacy plan. A traditional estate plan deals merely with what happens to an artist’s property when the artist dies. It fails to capture the totality of who the artist was during their life or the impact the artist and their works had on society and culture."

We dedicate this talanoa in remembrance of Ermehn, also known as Herman Loto, a founding member of Mahi Moana, a pioneer of music in Aotearoa, who passed away unexpectedly in 2023, and Fuimaono Tuiasau, Mahi Moana’ inaugural legal advocate for Mahi Moana who also passed recently. Both Gentlemen, originate from South Auckland are alumni of De La Salle College, were actively engaged in community endeavors.
