Important news from the California Association of REALTORS®2 Important Changes
The spirit of the Settlement is that ALL compensation is negotiable. Therefore, the Seller cannot dictate compensation to the buy side.
To reflect this;
1. Effective immediately, the guidance from our C.A.R. legal counsel is: “There shouldn't be offers of compensation to the buy side ANYWHERE”.
2. The December release of new forms will include an updated RPA that will incorporate the current SPBB into the main body of the contract. Thus, the SPBB will be discontinued. What this means to us….
Compensation should NOT be on any flyers, websites, or marketing materials (this includes social media and chat rooms). If you are asked how much compensation is being offered, the answer is “The Seller is willing to consider offers asking for concessions or compensation.”.
