Overview:

The Department for Enterprise has launched several consultations regarding employment rights and related legislation. The consultation topics are as follows:

  • Parental and Caring Rights: Including redundancy protections, neo-natal care leave, and carer’s leave.
  • Annual Leave and Rest Breaks: Statutory provisions for annual leave and rest breaks.
  • Trade Union Legislation: Including ballot threshold requirements.
  • Employment Status: Clarifying the differences between workers and employees, and the rights afforded to each group.
  • Unfair Dismissal: Qualifying periods and maximum awards.
  • Minimum Wage Act 2001: Review of its operation.
  • Employment Agencies Act 1975: Review of this legislation.

All consultations can be accessed on the Government Consultation Hub here and will remain open until 29th November 2024, except for the Trade Union Legislation consultation, which will close on 6th January 2025. Full text documents are available on the individual consultation pages to review all questions prior to participation.

Presentation:

Chamber Board member Caren Pegg, Partner at Appleby, will deliver a presentation to members to ensure these significant consultations are well understood. These consultations have the potential to bring substantial changes for businesses and employers. Therefore, we strongly encourage members to engage with the Chamber to gain a comprehensive understanding.

The presentation will provide an opportunity for Caren to outline the current situation and proposed changes. This will be followed by a survey for members to complete, enabling the Chamber to represent a clear mandate to the Government.
