James Earwaker from Willis Towers Watson (WTW) will discuss the recent shift towards a broader view of accountability arising from cyber events. For example, immediately following the failed Falcon update on 19 July, CrowdStrike’s share price tumbled. It subsequently fell by USD168 or 44%. Multiple class actions have been filed. These include disgruntled investors who claim the company deceived them regarding its software testing practices, as well as airlines including Delta who cancelled 30% of their flights and are claiming US$500m.
James will also discuss the fallout from the 2018-2020 cyberattack "SUNBURST" experienced by customers of SolarWinds. Its CISOs and C-Suite executives face allegations by the US Security & Exchange Commission of negligence and fraud among other class actions.
During this session James will explore how insurance programmes can be deployed to transfer the financial risk in these failures. These situations expose directors and senior management to significant fines, civil damages, massive legal costs, and serious reputational harm.

James manages the Wellington & Central region for WTW, a leading global insurance and risk advisory firm. He specialises in the placement of financial and executive risks transfer programs - which includes Directors & Officers Insurance and Cyber Liability Insurance. James has significant experience in advising corporate and business directors and executives of the personal financial risks that can face from organisational errors and omissions, or the accusation of such. Informing his expertise in risk management strategy is his 17 years working across the insurance markets in London, Australia, and New Zealand.
