By entering District 385 (the “Venue”), you acknowledge and agree to the following terms:
1. Assumption of Risk
District 385 is a multi-level event space, bar, and lounge environment that may include loud music, dim lighting, flashing lights, fog effects, stairs, elevated areas, and crowded conditions. By entering, you voluntarily assume all risks associated with being in the Venue, including the risk of physical or emotional injury.
2. Health & Safety
Individuals with medical conditions that may be triggered by loud audio, lighting effects, or crowded environments should use discretion when entering. If at any time you feel unwell or unsafe, please notify staff immediately.
3. Conduct & Physical Contact
Guests must conduct themselves respectfully at all times. Physical aggression, harassment, disorderly conduct, or unsafe behavior toward other guests or staff will result in immediate removal without refund.
4. Personal Property
District 385 is not responsible for lost, damaged, or stolen personal belongings. Please keep valuables secure at all times.
5. Photography & Recording
Photography and recording are allowed unless otherwise posted or restricted for specific events. However, professional equipment, flash photography, or filming of staff or other guests without consent is prohibited. Violations may result in removal.
6. Property Care & Damage
Guests must not remove, misuse, alter, or damage any furniture, décor, equipment, or fixtures. Any damage caused by you—whether intentional or due to unsafe behavior—may result in financial liability for repair or replacement and removal from the Venue without refund.
7. Photo & Media Consent
By entering the Venue, you grant District 385 NYC and its designees permission to capture photos or video that may include your image, and to use such media for advertising, promotion, and other commercial purposes in any medium worldwide, without compensation.
8. Release of Liability
You release District 385, its owners, employees, contractors, and affiliates from any claims relating to injury, loss, or damage that may arise from your presence in or use of the Venue.
9. Age Requirement
Guests must comply with all age restrictions posted for specific events or bar service. Minors may only enter when permitted and must be accompanied by a parent or legal guardian, who agrees to these terms on their behalf.
