Tenth Annual Symposium: Representing Accused Students

In 2011, the U.S. Department of Education, combined with public pressure and investigations, led colleges and universities to revamp their handling of sexual assault complaints. Students, faculty, and lawyers complained that the retooled investigative efforts and hearing processes adversely impacted the rights of both victims and the accused. The Department of Education rescinded the guidance and implemented new regulations, reversing course on a federal policy that played an important role in driving schools to do more to protect sexual assault victims.

The Department is, again, proposing to revise the regulations but has faced court challenges. Meanwhile, court decisions continue to shape and influence the legal landscape. This Symposium features attorneys with experience in handling student conduct hearings at various stages, and those who handle subsequent litigation.
