Lesley King: Private Client Update
This session will provide a review of current issues in Private Client Practice. The session will focus on good practice and avoiding pitfalls. The content will depend on developments during 2024 but is likely to include:
· A look at errors in will drafting in recent cases including Pead v Prostate Cancer UK
· Any developments in relation to the Trust Register
Objectives
After completing the session delegates will be:
• aware of recent developments in the private client area
• able to amend office practices appropriately.
John Barnett: How to give things away but keep control
In this session John will compare trusts, family investment companies, partnerships and other structures which enable donors to give assets away but keep back varying degrees of control. The session will look not only at the tax differences between various structures, but also at the practical, regulatory and asset-protection aspects of the different alternatives.
Objectives
After completing the session delegates will be:
• better able to identify client issues, and advise accordingly.
Alex Cisneros: Speaking about LPAs for Business - Practical Tips & Avoiding the Pitfalls
The presentation will cover LPAs for use for business affairs, practical tips and drafting. Alex will provide some context about when they may be used, or even when not to use them!
Objectives
After completing the session delegates will be:
• able to more confidently draft and advise on business LPAs
• be able to spot pitfalls

Profiles
Lesley King
Professor Lesley King is a former member of the Probate & Estates Committee of STEP, a former member of the Law Society’s Wills & Equity Committee and an honorary member of the Association of Contentious Trust and Probate Specialists and Solicitors for the Elderly. She is Professional Development Consultant at the University of Law.
She is co-author of Wills, Taxation and Administration: A Practical Guide; A Modern Approach to Wills, Administration and Estate Planning (with Precedents); A Modern Approach to Lifetime Tax Planning for Private Clients (with Precedents); A Practitioner’s Guide to Wills; Varying the Disposition of an Estate after Death; Wills: A Practical Guide; and editor of The Probate Practitioner’s Handbook.
She is a contributor to the Wills and Trusts volumes of Halsbury’s Laws and the Encyclopaedia of Forms and Precedents and to The Law and Ethics of Dementia.
She writes and lectures extensively on wills, taxation and related matters.
John Barnett
John has worked at Burges Salmon for nearly 25 years and is a partner in the private client services team.
He provides tax advice to a wide-range of high-net worth individuals and many leading banks and other financial institutions. He has a particular focus on entrepreneurial clients, many of whom are not domiciled in the UK or have business or other interests abroad.
John chairs the CIOT’S main Technical Committee and is a member of the CIOT’s governing Council. He was a member of the General Anti-Abuse Rule (GAAR) panel that approved HMRC’s initial GAAR guidance.
He has led the CIOT's response on a large number of capital tax policy discussions with HMRC and HM Treasury since 2006 including in particular the domicile changes since 2008 and the statutory residence test.
Alex Cisneros
Alex Cisneros, Outer Temple Chambers, is a specialist public law and private client barrister. He has experience handling significant contentious and non-contentious matters with a particular emphasis on mental capacity and education. Alex acts regularly for the Official Solicitor, the Office of the Public Guardian, local authorities, CCGs and family members. In the last twelve months he has appeared as junior counsel in the Court of Appeal and regularly appeared in Tier 3 (High Court) Court of Protection cases.
Dates for your diaries: we are hoping to get a fan favourite in for another interactive event in Ocotber, and an equally popular speaker on elderly client matters in November. In Februuary 2025 we'er aiming for a seminar on how to avoid contentious matters, with more to be annoucned when possible.
