Yet again, the word momentous fails to describe the last session of the US Supreme Court. The justices granted presidents immunity from criminal prosecution, enabled cities to ban homeless encampments, and limited the power of administrative agencies. In addition, the court found that laws temporarily banning domestic abusers from owning firearms did not violate the the Second Amendment.
On Wednesday, October 9, Erwin Chemerinsky, the Dean of Berkeley Law, returns to Arts & Culture just as the Supreme Court reconvenes. He will discuss its most recent rulings and preview some of the significant issues it will consider in its new term. These include cases about transgender rights and state regulation of the internet.

Dean Chermerinsky also will preview his brand new book, , which will be available for purchase. In it, he argues that the Founding Fathers made choices when drafting the Constitution that now endanger American democracy. Among the serious problems Dean Chemerinsky cites are how the Constitution treats race, prioritizes the Electoral College over the popular vote, and creates a “glaringly unrepresentative Senate.” He also claims that, by granting Supreme Court justices lifetime terms, the Constitution gives the modern court outsized influence, upending the balance of power.
Legendary for his keen analyses and clear, concise explanations of complicated legal issues, Dean Chemerinsky writes and lectures widely. His books, articles, and newspaper columns make legal scholarship accessible far beyond law school walls.
Last year, the California Lawyers Association Public Law Section awarded Dean Chemerinsky it’s highest honor for his “exemplary contributions to educating lawyers and the public about the Constitution and the rule of law. His … prolific writing and public speaking have helped to improve the public's understanding of legal principles, which are critical to a functioning democracy."
Dean Chemerinsky assumed the leadership of Berkeley Law in 2017, the same year National Jurist magazine named him the most influential legal scholar in the country. He is a past president of the Association of American Law Schools, the author of more than 200 law review articles, and a contributing writer for the Opinion section of the Los Angeles Times. His also is a regular columnist for the Sacramento Bee, the ABA Journal, and the Daily Journal. He frequently argues appellate cases, including before the Supreme Court.
