About this Event
Building upon the RICS NZS 3910 Construction Contract training, this masterclass course will give attendees confidence in both reading and writing special conditions of the contract and provide an understanding of pitfalls to avoid getting it wrong. It also highlights key changes reflecting the new requirements in NZS 3910: 2023.
During the training we will examine in further detail the key contract clauses, the interpretation and practical application of those clauses. Attendees will gain valuable insight into how decisions are made when reviewing common causes of construction contract-related disputes. This course will explain how disputes can be avoided if the correct process is followed from the inception of a project.
Course Structure:
- Review of the NZS3910:2013 and the highlighted changes to the 2023
- Special Conditions Schedule 1: how to complete them properly and how to interpret what has been written by others.
- Special Conditions Schedule 2: what should be attended to in this schedule? Why it is important to include a Schedule 2? Implications of common clauses that are added.
- Writing Special Conditions
- Extension of time review, process, causes and remedies.
- Examination of key clauses that attendees deal with:
- Programme
- Variations
- Default and Termination
- The importance of managing expectations of the parties and the softer skills that are crucial to avoid disputes from manifesting themselves.
- Discussion workshop providing time for attendees to bring to the class any particular issues they wish to discuss.
Learning Outcomes:
The course teaches best practice principles from both client and contractor perspective. The training is practice-based and will give added confidence when dealing with contractual issues. It also tackles an element of communication.
Course Prerequisites:
- Attendees must prepare a synopsis of the particular areas of focus you wish to discuss during the workshop. Please send the synopsis to Monica Sun: [email protected] at least one week in advance of the training.
- Attendees must bring a hardcopy (preferred) or electronic copy of the NZS 3910 contract with them to the training. This can be purchased by clicking this link: Standards New Zealand (2013 version)
- Ideally, attendees would have attended the RICS NZS 3910 Construction Contract training previously.
Trainer’s background:
Presented by Sue Morse – FRICS, Quantity Surveyor and Commercial Manager with 30+ years in the Construction industry - both Contractor and Client roles. Sue has been involved in the resolution of many disputes, both formal and informal, and gained valuable insight on how to avoid disputes and to resolve them once they have occurred. She has been involved at both pre-contract and post contract administration stages of contracts, across many aspects of the industry giving her a wealth of knowledge and solutions to common problems.
