The Nude Model Paint & Sip Experience is a painting event like no other! We’re throwing out the boring high heel and sunflower paintings to make room for our nude figure model masterpieces. There will be a nude male model present and everyone will be painting him on their blank canvas. Yes, the model will be NUDE! This painting experience will feature an African American male model.

• Seating arrangement is on a first come, first serve basis unless seat reservations are being offered.
• Seats cannot be held for your guests who are not present.

• **Waiver of Liability for Model Behaviors**: Sips of Art, LLC is not liable for any behaviors or actions of contracted models during The Adult Art Class.
• **Email Marketing and SMS Marketing/Communication Permission**: By purchasing a ticket for The Adult Art Class, participants consent to receive email and SMS marketing communications from Sips of Art, LLC. They may opt out at any time.
• **Government Issued Identification Requirement**: Ticketholders must present a government-issued identification for access to The Adult Art Class. Entry will be denied without proper identification.
• **IP Address Collection**: Sips of Art, LLC may collect IP addresses for security, analytical, and marketing purposes.
• **Personal Data Collection**: Sips of Art, LLC collects personal data for ticket purchases and marketing purposes. By providing personal information, participants consent to its use as described in the Privacy Policy.
• **Use of Personal Data for Chargeback Challenges and Fraud Prevention**: Personal data may be used to challenge chargebacks and fight fraud related to ticket purchases for The Adult Art Class.
• **Government ID Scanning**: The government ID of ticketholders will be scanned at the time of class entry. Entry may be denied if proper identification is not provided.

**Limitation of Liability:**You assume all risks associated with inclement weather. Event dates, times, and locations are subject to change. In the event of any changes, you will be promptly notified via email. Refunds will not be provided for venue changes. On occasion, events may be canceled or rescheduled. If this occurs, we will make every effort to contact you regarding refund or exchange procedures. If an event is canceled, a refund will be automatically issued to the original form of payment used for ticket purchase.You and your guests agree not to attempt to circumvent any refund restrictions regarding purchased tickets. This includes refraining from seeking refunds or exchanges when prohibited by our terms or our clients. Any attempts to dispute or initiate chargebacks through your credit card company for ticket purchases will result in cancellation of tickets and refusal of future purchases. Refunds for canceled or postponed events will be issued for the face value of the ticket.You acknowledge and understand that all independent contractors associated with Sips of Art, LLC are solely responsible for their own actions. Under no circumstances is Sips of Art, LLC liable for the actions of these independent contractors during any class or event. You agree not to hold Sips of Art, LLC responsible for the actions of any independent contractors present at any class or event.**NOTICE OF FILMING AND PHOTOGRAPHY**By purchasing a ticket and entering the venue of our event hosted Sips of Art, LLC, you and your guests acknowledge and understand that you will be entering an environment where photography, audio recording, and video recording may take place.**Consent to Recording and Use of Materials:**By purchasing a ticket to this event and entering the venue of our event hosted Sips of Art, LLC, you grant consent to interviews, photography, audio recording, and video recording, and authorize their release, publication, exhibition, or reproduction for use in news, webcasts, promotional materials, telecasts, advertisements, inclusion on websites, social media platforms, or any other purpose deemed appropriate by Sips of Art, LLC and its affiliates and representatives. These materials may also be used to promote similar classes in the future and to showcase the capabilities of Sips of Art, LLC.**Waiver of Liability and Release:**You hereby release Sips of Art, LLC, its officers, employees, and all individuals involved in the taking, recording, digitizing, or publication of interviews, photographs, computer images, video and/or sound recordings from any liability associated with such activities. You understand that by entering the event premises, you waive any claims for payment or royalties in connection with the use, exhibition, streaming, broadcasting, webcasting, or other publication of these materials, regardless of the purpose or sponsorship of such activities, and regardless of whether a fee for admission or sponsorship is charged.**No Right to Inspection or Approval:**You acknowledge that you have no right to inspect or approve any photo, video, or audio recording taken by Sips of Art, LLC or by any person or entity designated to do so by Pete and Paint, LLC.**Informed Consent:**By purchasing a ticket to this event, you confirm that you have been fully informed of your consent to the recording and use of materials, and that you understand and agree to the waiver of liability and release outlined above.Your participation in the event signifies your acceptance of these terms and conditions regarding filming and photography. If you do not agree with these terms, please refrain from purchasing a ticket or entering the event premises.**Chargeback Prevention and Arbitration Agreement:**By purchasing a ticket for The Adult Art Class hosted by Sips of Art, LLC, you agree to waive your right to file a chargeback with your credit card company or financial institution for any reason related to your ticket purchase. You acknowledge that all ticket sales are final and non-refundable, as stated in our terms and conditions.In the event of a dispute or issue with your ticket purchase, you agree to first contact Sips of Art, LLC directly to seek resolution. We are committed to addressing any concerns promptly and fairly.By waiving your right to initiate a chargeback, you understand that you are forfeiting the option to dispute the transaction with your credit card company or financial institution. You agree to resolve any disputes or issues directly with Sips of Art, LLC.This chargeback prevention clause is a binding agreement between you and Sips of Art, LLC, and applies to all ticket purchases for The Adult Art Class. Failure to adhere to this clause may result in legal action to recover any disputed funds, as well as additional fees and penalties incurred by Sips of Art, LLC.By proceeding with your ticket purchase, you acknowledge that you have read, understood, and agreed to abide by this chargeback prevention clause.By purchasing a ticket you hereby agree to the following terms regarding chargeback claims and dispute resolution:1. **Chargeback Prevention Clause**: You acknowledge and agree that you will not initiate a chargeback claim with your bank or credit card company for any reason related to your ticket purchase. Instead, you commit to resolving any disputes or issues directly with Sips of Art, LLC.2. **Automatic Redirection Requirement**: In the event that you attempt to file a chargeback claim with your bank or credit card company, you understand and agree that your financial institution will automatically redirect you to resolve the matter with Sips of Art, LLC. You waive your right to pursue a chargeback and acknowledge that Sips of Art, LLC is the appropriate entity to address any concerns regarding your ticket purchase.3. **Arbitration Agreement**: Any disputes, claims, or controversies arising out of or relating to your ticket purchase or attendance at The Adult Art Class shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration service or, if no agreement can be reached, by a reputable arbitration service chosen by Sips of Art, LLC. The arbitration shall be conducted in accordance with the rules and procedures of the chosen arbitration service, and the arbitrator's decision shall be final and binding on all parties involved.4. **Requirement for Disputes**: Prior to initiating arbitration proceedings, you agree to first attempt to resolve any disputes or issues directly with Sips of Art, LLC in good faith. If a resolution cannot be reached through direct negotiation, arbitration may be pursued as outlined in this agreement.By purchasing a ticket for The Adult Art Class, you acknowledge that you have read, understood, and agreed to abide by these chargeback prevention and arbitration terms. You further acknowledge that failure to comply with these terms may result in legal action to enforce the terms of this agreement, as well as any additional fees and penalties incurred by Sips of Art, LLC.**General Liability Release of Claims:**In acknowledgment of the risks associated with participating in any art event ("Event") sponsored, operated, or conducted by Sips of Art, LLC, and as a condition for the privilege of participating in such Event, the undersigned ("Participant") hereby knowingly, voluntarily, and without any inducement enters into this BYOB Release and Waiver Agreement ("BYOB Release").Participant hereby assumes all risks associated with participation in any and all activities associated with the Event. Participant understands that Sips of Art, LLC does not promote or encourage BYOB (Bring Your Own Bottle) and/or alcohol consumption.Participant acknowledges that Sips of Art, LLC does not provide on-premise alcohol and that any alcohol present at the Event is brought by participants. Participant agrees not to serve alcohol to minors, individuals under the influence of alcohol prior to the Event, individuals displaying disorderly behavior, those addicted to excessive alcohol consumption, or individuals consuming alcohol in any vehicle on the premises.Participant acknowledges that alcohol consumption can be highly addictive and may impair cognition, judgment, vision, motor skills, speech, and may enhance aggression, agitation, and promote compulsive behavior. Participant further acknowledges that excessive alcohol consumption may lead to various health issues, including but not limited to nausea, vomiting, drowsiness, diarrhea, upset stomach, headaches, and breathing difficulties. Participant agrees and understands that Sips of Art, LLC shall not be held liable for any property damage, charges, injuries, or deaths that may occur due to Participant’s consumption or provision of alcohol during the Event.Therefore, I, Participant, for myself and on behalf of my heirs, executors, successors, personal representatives, administrators, and assigns, do hereby agree to:(A) Waive, release, and discharge Sips of Art, LLC, its officers, managers, members, promoters, owners, employees, volunteers, contractors, affiliates, landlord, and business partners (the "Released Parties") from any and all liability, including but not limited to, liability arising from the negligence or fault of the Released Parties, if any, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from the Event;(B) Indemnify, hold harmless, and promise not to sue the Released Parties from any and all liabilities or claims made as a result of participation in the Event, or my consumption of alcohol at the Event, whether caused by the negligence of the Released Parties or otherwise.Participant acknowledges and agrees that Sips of Art, LLC, and their managers, members, officers, volunteers, representatives, and agents are not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. Participant hereby consents to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during the Event. This BYOB Release and the Participant Release and Waiver Agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.This Release has been carefully read and fully understood by the undersigned. I am freely, knowingly, and voluntarily entering into this Release by purchasing a ticket to attend a Sips of Art, LLC Class and/or event.**License; Ejection and Cancellation; No Redemption Value:**By purchasing a ticket to attend a Sips of Art class or event, you and your guests agree to abide by all applicable rules, policies, terms, and conditions set forth by the Event Providers ("Event Provider Rules"). The Event Providers reserve the right, without refund of any amount paid, to deny admission to, or eject, any individual whose conduct is deemed disorderly, who uses vulgar or abusive language, or who fails to comply with the Event Provider Rules. Any breach of these terms or rules will result in the termination of your license to attend the event without refund.A ticket represents a revocable license, and admission may be refused with a refund of the ticket's face value. It is important to note that a ticket holds no cash redemption value.By purchasing a ticket, you acknowledge that your state identification will be checked and scanned by a Sips of Art representative upon entry to the venue/event space. Failure to comply with this check-in procedure will result in denial of entry, and no refund will be provided.Your understanding and compliance with these terms are crucial to ensure a safe and enjoyable experience for all attendees.
