With the wave of inconclusive pay negotiations and related strike action continuing into 2023, the choppy waters of the associated legal issues will require careful navigation, in both the public and private sectors.

This practical talk will consider:

  • Requirements for protected industrial action and injunctions/damages
  • Mitigating the effects of protected industrial action
  • Recognition, collective bargaining, and the dangers of unilateral pay awards
  • The latest developments in detriment and dismissal claims

Julian and Geraint will examine the Equality Act 2010 implications of recruitment and off boarding in the light of recent caselaw and practice developments.

Menopause in the workplace – Anna Williams, Guildhall Chambers

This workshop will address menopause at work and the surrounding legal framework, in particular the Equality Act 2010. The session will focus on key issues for employment practitioners, including litigating menopause discrimination claims and advising on workplace policy and practice.

Taking comfort in your covenants? Determining the enforceability of post-termination restrictions – James Wibberley & Lottie Mallin-Martin, Guildhall Chambers

In this interactive workshop, James and Lottie will explore some of the barriers to enforcing post-termination covenants in an employee’s contract of employment, and they will suggest some practical tips to prepare for the fast-paced litigation that may follow.

Flexible Working in a post-pandemic world - Kerry Gardiner & James Lewis-Bale, Guildhall Chambers

The COVID-19 pandemic has shown that working from home can be both fruitful and successful for employers and employees alike however, with changes on the horizon to both the legal position in relation to flexible working applications and business requirements how should applications be approached?

In light of these changes, Kerry and James will explore whether and how an employer can now legitimately deny requests for flexible working, alongside how employees can maximise their chances of success in achieving their desired outcome.
