AMERICAN LEGION LIBERTY POST 308 & LEGION MEMORIAL ASSOCIATION, INC. GHOST TOUR WAIVER, RELEASE, AND HOLD HARMLESS AGREEMENT

1. Eligibility & Identification This event is 21+ only. A valid government-issued photo ID must be presented at check-in. No refunds will be given for failure to provide proof of age.

2. Event Conditions & Risks The participant understands and acknowledges that the Ghost Tour will include:

• Dim lighting
• Stairs
• Areas with uneven subflooring and gaps in flooring
• Stepping over some structural elements
• Uneven surfaces throughout
• NOT ADA compliant – The venue is not accessible for individuals requiring mobility accommodations.
• Unfinished attic
• Possible exposure to dust, debris, and sudden loud noises

By signing this agreement, the participant voluntarily assumes all risks associated with participation.

3. Behavior & Substance Use

• The use or possession of illegal drugs is strictly prohibited.
• Participants agree to consume alcohol responsibly. Excessive drinking or intoxication that could impair safety or disrupt the event is not allowed.
• The hosts reserve the right to remove any participant whose behavior threatens the safety or enjoyment of others.

4. Release & Hold Harmless In consideration for being permitted to participate in this event, the participant agrees to release, discharge, and hold harmless American Legion Liberty Post 308, Legion Memorial Association, Inc., its officers, members, employees, and volunteers from any and all liability, claims, demands, or causes of action, whether known or unknown, for any injury, illness, death, or property damage arising from participation in this event.

5. Behavior & Property Rules

• No touching, removing, or tampering with property or artifacts.
• No entry into unauthorized areas.
• Any damage caused by the participant will be the responsibility of the participant, including the cost of repair or replacement.

6. Medical Disclaimer The participant certifies they are physically able to participate and have no conditions that would be aggravated by uneven surfaces, stairs, dim lighting, stepping over structures, or other event conditions.

7. Binding Effect This agreement is binding upon the participant, their heirs, executors, administrators, and assigns.

• Harassment, intimidation, or disruptive behavior toward staff or guests will not be tolerated.
• Violators may be removed without refund.

• Do NOT touch, move, or remove any property, artifacts, or structural elements.
• Stay within designated tour areas.

• Participants assume all risks related to the event.
