This is a practical, agent-focused workshop led by a Pennsylvania Department of Environmental Protection (DEP) representative. It covers what happens when a property transaction involves an existing oil or gas well, especially legacy wells, and what DEP expects when a well is adopted or when responsibility is transferred.
Agents will leave with a clearer framework for advising buyers and sellers on due diligence, risk, timelines, and the basic steps clients may need to take to stay compliant.
What the DEP is Expected to Cover:
- Key terms and responsibilities: orphan vs abandoned wells; who is responsible and when responsibility changes.
- Transfer basics for agents: transfer of well ownership is different from transfer of the DEP well permit or registration, and the permit or registration cannot be transferred without DEP approval.
- Adoption pathway: when a Permit Application to Adopt an Oil or Gas Well (DEP form 8000-PM-OOGM0110) is used, what DEP typically reviews, and what obligations are assumed when adopting an orphan or abandoned well.
- Transfer pathway: overview of the Application for Transfer of Well Permit or Registration (DEP form 5500-PM-OG0010), what DEP approval means, and practical expectations during the transition.
- Timing and common pitfalls: the 30-day notice expectation after a transfer of well ownership, documentation gaps, and deal issues that show up in real transactions.
- Where to find forms and official resources: DEP Oil and Gas forms and related guidance in the DEP eLibrary and program pages.

- Any documents you have: prior permits, registrations, transfer paperwork, production or reporting records.
