About this Event

We understand that digital engineering has been around for many years, especially 3D models, however it is painfully apparent the current approaches to establishing Contracts and managing commercial Risk thereof no longer suit the latest technological advancements in mining project delivery.

With advancements in digital engineering comes a wealth of project information that was previously difficult to collate and easily share. However, even now with our advanced technologies, this information is not being transferred to the contracting party who need it most. The fear stems from Intellectual Properties rights to Liability for the information shared.

Is it not about time we explore alternative approaches to drafting Contracts and managing commercial Risk?

The Event

This event is about understanding the basic building blocks of conventional contract and legal risk management and exploring how it might be changed to accommodate upcoming technologies offered through 3D Mining Information Modelling (MIM).

Presentation includes:

  • What elements make up a legally binding contract?
  • How do contracts and the common law deal with “liability” and “risk”?
  • How has risk traditionally been managed, including risk controls and risk transfers?
  • What are the conventional approaches to ownership and sharing of information and intellectual property?

We will then open the floor for a discussion on how conventional contracting approaches using 3D models limits innovation and unfairly passes risk to those who have the least control over it.

Our discussion will then centre around how DEiM can be used to reduce and manage risk more appropriately as an alternative to the traditional transactional approach.

Presenter

Gemma is a contract lawyer and founder of SoundLegal based in Perth, Australia. SoundLegal specialises in front end contract advice to Principals, Contractors, Subcontractors and Consultants.

Gemma has drafted and reviewed thousands of design services and consulting agreements, construction contracts and other commercial and legal documents. Her experience includes negotiating public and private sector contracts across large-scale engineering, construction, infrastructure and consulting projects which stands her in good stead to advise and represent a broad spectrum of businesses, from SMEs to large corporates.

Digital Engineering in Mining group was borne out of a desire to bring like minded engineering, construction and operating professionals together to openly discuss new and different approaches to delivering mining projects.
